Skilled Worker (TIER 2) Dependent VISA

Introduction

A Skilled Worker visa (Tier 2) allows the applicant to come to or stay in the UK to do an eligible job with an approved employer. Skilled worker (Tier 2) Dependent VISA is for the partner/children of those with Skilled (Tier 2) Dependent VISA. The benefits of Tier 2 visa is that the holders can sponsor their dependents to the UK. Tier 2 Dependent visa holder can work in the UK, can access the NHS for medical care and also settle in the UK.

 

Types of Skilled worker (TIER 2) Dependent VISA

1. Partner Dependent VISA (Tier 2) for skilled worker

In order to apply as a partner dependent for skilled work visa, you must be able to prove that either:

  • You’re in a civil partnership or marriage that’s recognized in the UK
  • You’ve been living together in a relationship for at least 2 years when you apply

2. Child Dependent VISA (Tier 2) for skilled worker

To apply for a child’s visa as a skilled worker, it must be proved that:

  • The child lives with you, unless they’re living away from home in full-time education - for example, at boarding school or university
  • not be married or in a civil partnership

 

What Can You Do With a Tier 2 Dependent Visa?

You will be able to do the following with Tier 2 Dependent visa:

  • Work, with some specific exceptions
  • Remain in the UK for the same amount of time as the validity of your family member's Tier 2 (or equivalent) visa.
  • Extend your visa along with your family member’s Tier 2 (or equivalent) visa, as long as they also continue to meet eligibility requirements
  • Apply to settle permanently in the UK (also known as ‘indefinite

You will not be able to do the following:

  • Claim benefits or access public funds.
  • Work as a doctor/dentist in training, a professional sportsperson or coach.

 

Applying as a Skilled Worker (Tier 2) Dependent VISA

An applicant either already in the UK or outside UK can apply for the Skilled Worker (Tier 2) Dependent VISA. Each one has their own certain criteria;

Applying from Outside of UK; The applicant will need to complete a separate application and pay the VISA fee. They must apply before they travel to the UK. The GWF or UAN numbers of Skilled (Tier 2) Worker are needed for the application process. The biometrics will be taken at VISA application Centre of their Home country or nearest VAF (could be in another country as well).

Applying from Inside of UK; If the main applicant has switched or extended their VISA, the dependents VISA will still be valid until its original end date. They must apply to extend or switch their VISA along with the main applicant or before their VISA expires.

They cannot apply as the dependent of skilled worker (Tier 2) VISA if they are;

  • on a visit visa
  • on a short-term student visa
  • on a Parent of a Child Student visa
  • on a seasonal worker visa
  • on a domestic worker in a private household visa
  • on immigration bail
  • because they were given permission to stay outside the UK immigration rules, for example on compassionate grounds

If the partner or child is currently in the UK on a Student visa, they can only switch if they have either:

  • completed the course they were sponsored to study
  • studied for a PhD for at least 24 months

 

Required Documents for VISA applications of a Skilled worker (Tier 2) dependent

The document requirements for VISA applications are subject to change, you can refer to gov.uk site for proper updated details. Also, the documents can be dynamic depending case wise. Generally, the required documents for skilled worker (Tier 2) dependent joining the main applicant are;

Passport copy and Visa Copy/BRP Card (colored copy)

The dependent would need to provide the main applicant's Passport, visa decision letter, and a copy of their BRP. Also, these documents are required to fill up the accurate details on the VISA application. VISA decision letter is compulsory for the application process.

Passport of dependent

Passports are necessary to travel abroad as they verify the identity and nationality. Along with that, a passport is the mandatory document for the application. The details such as bio data, recent travel history, visa grant/rejects details in the passport are crucial for the application process. The VISA sticker gets attached to your passport once the visa is granted.

TB Test Certificate

TB screening is mandatory for those coming to the UK for 6 months or more. Similarly, it is required for skilled worker (Tier 2) Dependent VISA too. For UK visa application, TB test done from only either of these location is valid;

  1. IOM; IOM stands for International Organization for Migration. IOM has TB test centre on two location;
    Kathmandu- Baluwatar
    Jhapa- Damak

    The Test fees are as follows;

    11 years and above Below 11 years Certificate reissue
    60 USD 40 USD 12 USD
    The fee will be payable in Nepalese rupees at the exchange rate set by the IOM.
  2. Norvic; Norvic International Hospital & Medical College Ltd located in Thapathali Kathmandu also provides the TB test for UK.

    The Test fees are as follows;

    11 years and above Below 11 years Certificate reissue
    NPR 7,800 NPR 5,200 NPR 1,300
    Female applicants aged 12 to 54 may be asked to pay NPR 650 to do a urine pregnancy test.

Once you pass the TB test; you'll be given a certificate which is valid for 6 months from the date.

Marriage Registration Certificate/Birth Certificate

If you are married or in a civil partnership, you would need to provide the marriage certificate or civil partnership certificate as a proof of relationship.

For dependent children, a birth certificate, or equivalent official government-issued documentation, should be used to demonstrate the relationship.

Proof of continued relationship while living apart

Evidence of an ongoing relationship such as evidence of regular communication, visits, holidays, events attended, financial support, joint care of any children the partners have together, or any other evidence showing an ongoing relationship are required too.

Maintenance Funds/Financial Requirements

Partner and child applying for a Skilled worker (Tier 2) dependent VISA should each might a certain amount of money available to them.

A. £285 for partner dependent
B. £315 for one child
C. £200 for each additional child

Or

You do not need to show the maintenance funds if the sponsor/job provider supports you for Maintenance funds. Your certificate of sponsorship must confirm this. Your employer will need to mark “Y” in the “Tick to certify maintenance for migrant (and dependents)” part in COS.

Relationship Certificate (both side)

Relationship Certificate is a legal document required to prove relationship between family member, husband, wife, children etc. This document is to be prepared from both sides in case of Partner Dependent, and a certificate showing relationship between parents and child is needed in case of Child Dependent.

Cover Letter by Applicant/SoP by dependent

Cover letter/Invitation Letter/Entry Clearance Letter/SOPs and so on are required in order to state and elaborate the intention of entry for dependent and as an invitation from the side of skilled worker.

Marriage Photographs (Hard Copy)

It’s required in the case of Partner Dependent, The following photos are to be submitted at VFS center as a supporting proof to prove that the couple are genuine;

a) Marriage Ritual Photos
b) Family Photos (both sides)
c) Couple After Marriage

COS Letter

A Certificate of Sponsorship is assigned by a sponsor license holder (employer) to enable sponsored visa applicants to apply for their work visa. The COS letter contains of details such as company name, license number, Job title, Job type, and so on.

Accommodation confirmation/tenancy agreement

Evidence should demonstrate how the Tier 2 and the dependent can legally occupy the accommodation. This could be via a copy of the property deeds, mortgage documents, tenancy agreement and/or letter from the landlord confirming that rent payments are up to date and the applicant/Dependent is allowed to occupy the property.

Police Clearance Certificate

You’ll need to provide a criminal record certificate if your spouse’s Job role is one of the following;

  • Education, for example teachers, education advisers and school inspectors, child minders, teaching assistants
  • Healthcare, for example nurses, doctors, paramedics, managers, pharmacists, dentists and dental nurses, ophthalmic opticians
  • Therapy, for example psychologists, speech and language therapists, counsellors
  • Social services, for example social workers, managers, probation officers, welfare and housing officers
